Last week the Land and Environment Court ordered the state government to transfer its ownership to the Awabakal land council.
The court ruled the state government had failed to prove the site was needed for essential public services or was being used or occupied.
The Awabakal land council will use the building as a training and healthcare centre.
About $10 million will be needed to repair the building, despite the fact the state government had already spent money on remediation work.
The state government's intentions revolved around a retail or hospitality development.
